These Are Not Diana Ross' Supremes.

That was then:

“We conclude that when the ground for asserting privilege as to subpoenaed materials sought for use in a criminal trial is based only on the generalized interest in confidentiality, it cannot prevail over the fundamental demands of due process of law in the fair administration of criminal justice. The generalized assertion of privilege must yield to the demonstrated, specific need for evidence in a pending criminal trial.”

That was the Supreme Court of Warren Burger issuing the order, based on an immediate 8-0 decision, that Richard Nixon must hand over the Watergate Tapes because he did not have blanket immunity from prosecution due to executive privilege as a sitting president on July 29, 1974.

****

This is now:

"Without expressing a view on the merits, this Court directs the Court of Appeals to continue withholding issuance of the mandate until the sending down of the judgment of this Court. The application for a stay is dismissed as moot.

The case will be set for oral argument during the week of April 22, 2024."

That was the current Supreme Court of John Roberts issuing the order that there will be no immediate order on February 28, 2024. Instead, there will be further delay in making any decision as to whether or not Donald Trump has blanket immunity from prosecution for committing acts of insurrection as an outgoing, but still technically sitting, president.

The latter two month delay until 'oral argument' commences means that it is very unlikely that the current Supreme Court will make a decision on Trump's ridiculous blanket immunity claim before the summer.

This very likely means that Mr. Trump will not go to trial before the US'ian presidential election in November.

It's important to realize that, if he were to win, it is even more likely that Mr. Trump would end the federal prosecution of his own acts of insurrection if his super slow walking Supremes were to rule against him in the summer.

That's some incentive to win at all costs, 'eh?

______
Why are there nine members of Burger's court in the image at the top of the post when the vote against Mr. Nixon was 8-0?....Because the guy in the glasses second from the right, William Rehnquist, actually recused himself because of his previous political association with the Trickster-In-Chief...Just one more thing that is very, very different now than it was then.

Respectfully, I say to thee
I'm aware that you're cheating

things have changed since the Nixon decision. Its not what is best for the country and its citizens but what is best for the party in office and its corporate sponsors. ethics are hard to find these days, as long as your group wins that is all that matters.

What surprises me is those who are ethically challenged usually, "sell out" for so little. Justice, I want a motor home and trips on private jets" none of these items were in the overall scheme of any great value. Yes, the motor home is nice, but its not a truly expensive item. Just check around at camp grounds. The trips, ditto. It may feed their egos, but in the grand scheme of things, if you're going to steal, don't steal something small, O.K. unless its a vintage postage stamp worth several million.
They ought to have listened to Anita Hill.

The other 3 newbies, they got their jobs, they're out of their intellectual leagues, but they are delivering on what they are put there fore. They've traded off their integrity and that of the Courts to chase some idiot christian extremists view of what women should the "allowed" to do. Add in the gun laws you do have a receipe for disastor. If Trump wins one way or another, what do people think is going to happen> Canada won't be out of the woods either. A country like the U.S.A. in turmoil is not going to be fun or pretty. there could also be a rather large number of refugees.
Canada might want to really put some money into our military, as in double its size and amount of equipment. We have the money, just tax guys like the owners of the big grocery stores, mining corporations, oil corporations, etc.
In the meantime you might want to keep your passport handy and check into NZ or Australia.
Some may think I'm over reacting, but if you have a look at history, going back to Roman, Greek, times and forward, things can happen quickly. Even WW II, that was fast and millions died. There are some interesting articles out and about, regarding the round up and deportation of American citizens in the 1930s. about a million and a half and 60% of them were actually American citizens. they just had ancestors who came from Mexico or had lived there when some of the country had been part of Mexico. Canada put citizens of Japanese descent in camps and destroyed a lot of lives, the government took away their houses, fish boats, etc.

So please no one ever try to tell me this can't happen again.

Has anyone thought this through?

If you give Trump immunity for his actions, you also give Biden Immunity for his actions.

If this is true, the Supreme Court Judges are "dead men walking", as is Trump and all the top coup leaders, because Biden can detain them and have "falling out of a window syndrome" quite legally because he will have presidential immunity.

His excuse, they were colluding with Russia for the overthrow of the United States.

Be careful what you wish for EE.

Not what I wish for but what is sauce for the goose, is sauce for the gander.

If Trump is reelected he will not leave, that is simple and we had a taste of it in 2021. Also the MAGA cult has been cozying up to Putin's Russia in a very uncomfortable way.

If there is any hint of election tampering from the GOP, Biden my declare an emergency and arrest the Supreme Court, and top MAGA officials and may accidentally kill a few of them. you see, he has immunity.

It is not what I wish for but................if the Supreme court grant Trump immunity by being a president, they also grant Biden having immunity and to save the republic from a MAGA coup, bad things may happen.

I'm not so sure it has anything to do with the actual decision.

Instead, it would appear that the key here is the delay.
