RailGate Reloaded - My Mama Mia Culpa

Following up on the British Columbia's own 'Spirit of Rosemary Woods' story regarding the erasure of the RailGate Tapes that contained Emails between the principals and/or cabinet ministers and/or Premier Gordon Campbell.....

Last week I wrote a post in which, based on recent statements by Mr. Campbell's man in the RailGate courtroom, Mr. George Copley, I wondered why the Solicitor General at the time, Mr. Rich Coleman, had not taken active steps to protect the tapes way back in 2003/2004.

Why did I do this?

Because, according to a report by Mark Hume in the Globe and Mail, Mr. Copley stated, in open court, that the Emails, some of which were sent in 2001/2002, had only been kept for 13 months.

And Mr. Coleman was Solicitor General during that period that would have extended into 2004.

But here's the thing.....

According to Gary Mason's report in Globe today, Mr. Copley must have have been somehow 'mistaken' in court:

"....The new information would appear to contradict statements made in court last month by government lawyer George Copley.....


Why?

Well, because an affadavit filed by the current director of the provincial government's 'Messaging and Collaboration Services' indicates that her department requested that tapes containing at least some of those Emails - Emails that had been requested by the defense previously, which is why Mr. Copely was speaking about them in court recently - be destroyed in May of 2009.

Yes.

May of 2009 when our latest provincial election campaign was underway.

So......

It is entirely possible that Mr. Coleman did, indeed, take active steps to preserve those tapes/Emails way back in May of 2004.

Thus, I apologize for my earlier suggestion which I arrived at based on Mr. Copley's recent statements in court.

Regardless, all of this raises a whole new set of new, important questions including.....

Who actually knew that the Emails still existed way back in May of 2004, a time when the mainline BC Railine deal was being secured and the consoloation Spurline deal was being scuttled because it was potentially 'tainted'?

And......

Who knew that the Emails still existed in May of 2009 when Mr. Copley mistakenly mis-spoke, in open court, last month?

Update: Had forgotten the evidence offered up by Mr. Copley to backstop his earlier assertions....Turns out it was an earlier affidavit from, get this!, the very same Director of "Messaging and Collaboration Services, Workplace Technology Services" (sound familar?) who wrote the bombshell affadavit that was revealed in court today. Neal Hall of the VSun had that story back in late June.
