Double-Secret Probation Update, 5:30pm: The Bloggodome's most acclaimed non-accredited journalist, Robin Mathews, adds a little sober second though regarding the possiblity that twelve minus two does not necessarily equal ten in the end (see bottom of post).....

Update, 3:00pm: It's game on for real this time folks!.....Judge has just informed the jury that the trial could go 10 months....Wow....That's a whole lotta witnesses to examine and cross-examine...Under oath....With documents (see bottom of page)!

Semi-LiveBlog for Monday June 7th, 2010...Goes top to bottom this time out...Just scroll on down for the latest info...

Preamble: OK....We've had lots of tries at re-starting Day 4 with G. Campbell's Chief-of-Staff Martyn 'Don't-Mistake-Him-More-A-Martini' Brown back on the witness stand for further cross-examination....So...Are the 'sniffles' all over?.....Is the 'legal-wrangling' done....Have issues under consideration 'resolved themselves'....Are there bluffs still on the table to be called?.....Stay tuned....

11:00am....Nobody has come running out of the courtroom screaming like a banshee, yet....So....Presumably, some bluffs have been (or are being) called....Next up will likely be lunchtime files from fully-accredited journos in-the-know...

11:30am....Hey!....Mr. T, Bill Tieleman, is back in the House/Courtroom/Saddle-Again....Great to see you back Bill!

12:00 noon...CBC BC, whose reporter, we have been told, is only 'semi-accredited', is reporting that the jury was not in courtroom this morning...Therefore pub ban on....Safe to assume, at the very least, that 'legal-wrangling', which cannot be reported on, is continuing...

12:20pm....Still nothing from the fully-accreditted journos....Did their crackberries tell them to stay away this morning, too?....Somehow, given the rumour mill that we know, with certainty, reached more than just the Bloggodome, we kinda doubt that....

12:35pm...Neal Hall of VSun is reporting that Mdme. Justice MacKenzie will bring the jury back into the courtroom and address them then...If things do continue with M. Brown on the stand again, watch for reports of 'rapport' (or not) between defense lawyers and judge to gauge how legal-wrangling/bluff-calling session went this morning because we won't find out for sure because of pub-ban....

1:00pm....Bill Tieleman confirms what N. Hall had to say above...Whew!...Always good to have a second, not-so-fully accredited, source we can trust...More importantly, (and with snark fully-off) Mr. T. says he will have a full report later, here....

1:30pm....The fine folks from Blogger have informed me that the 'comments' issue that has been messing us up since last night has been fixed....Since I've gotta go offline for awhile, feel free to keep us up-to-date if anything comes up...especially in that critical 2-3pm timeslot after the jury is addressed and, presumably, not dismissed.....Oh, and for those that just wanna weigh in, feel free (Anon-O-Mice always welcome - which is why I leave 'em wide open)....

3:15pm....Oooh, Baby....Can this really be the end?....(or the real beginning)....Stuck inside the Mobile with the Railgate Blues Again?!....Somebody (or maybe everybody) sure must have blinked!...Because our friend GAB (ya, and Mark Hume too) is reporting that the judge just told the jury that the trial could now go for, get this!....10 months!!!....Bring ALL the witnesses on!....

4:00pm...OK, have calmed down a little now....Hard to have a quick look at the I'Webz and then go back in the lab and try and focus on shuttle vectors and green fluorescent protein tags....But.....Bill Tieleman, posting at his own blog, now has the most fulsome report up so far....Includes details like the Judge imploring that the current jury stay on (if they don't they'll likely have to pick a new one)...That there will be a big recess after July 7th (after all, lawyers, given that they are by far the least 'productive' wage earners in the Western world, need pretty much the entire summer off as well as no work Fridays for, essentially, ever)...And that Martyn Brown won't appear on the stand again until Wednesday....At the earliest.....Oh well, what's one more day or seven now that we know that a few folks in the know are really sweating, eh?

5:30pm....Robin Mathews now has his take on the full days proceedings up at Mary's....He's got extras...Specifically, after the judge told them about the new timeframe they deliberated for a while and then came back and told the court that only 10 of them can say yes right now...The other two need to sleep on it...The answer will come tomorrow.....If they say no then, yes indeedy rumour-mongers you may be proven be 'technically' correct in that there might be mistrial declared given that 10 jurors is apparently the absolutely bare minimum....However, even under that scenario it looks very likely that we would just start all over again, which means that you rumour mongers would be demonstrably and emphatically wrong in the only way that truly matters....I'll have more to say about all this cryptic 'rumour' business, later....And I am most definitely NOT under either a court- or a self-imposed publication ban when it comes to that kind of stuff, especially given that it was initially floated on the public airwaves last Friday.....Ha!

So, why couldn't the jury have been told before the weekend that the estimate of the trial length has increased to 10.5 months so they could have given the judge an answer today rather than have to wait for tomorrow on the decision of the final 2 jurors?

Why?

Because according to 'sources' there was a big 'ol game of chicken goin' on....

And somebody called somebody's bluff!!

Regardless, 10 months is a WHOLE LOTTA WITNESSES....

Can we even eat that much popcorn?

Campbell must be ____________(fill in the blank). He figured that the trial would be over before the Fall sitting which has been cancelled by the BC Liberals in all probability and now the Jury will be rendering a verdict just after the Spring Budget is presented.

I also think, Ross, that this says something quite interesting about the lady on the bench.

Her ignorance, I mean, of the complexities of the case, the sheer quantity of evidence and the potential significance of the witnesses to be called. Given all that, her original expectation that this circus was only coming to town for 6 - 8 weeks couldn't have been more than naïve wishful thinking.

She clearly lacks the kind of knowledge that Bennett possessed…among other things.

I'm loving you coverage. Kudos to the Watcher on the Courthouse Steps who reports on sightings of people who run screaming from Courtroom 54 ...

About the miscalculation of a 6 to 8-week trial, it was The Crown Prosecutor, the very special Mr Berardino himself, who said it.

Robin Mathews heard him say it ... said so ... and had his facts confirmed by one of the Defence lawyers.

The odd thing is that any of us, who care about the BC Rail Political Corruption Trial, could've easily assisted The Honourable Madam Justice Whatshername in solving this simple mathematical calculation.
