Essentially, it will be this, taken directly from Federal Justice Anne Mactavish's ruling on the matter:
"...I am satisfied that the affected individuals are being subjected to “treatment” as
contemplated by section 12 of the Charter, and that this treatment is indeed “cruel and unusual”.
This is particularly, but not exclusively so as it affects children who have been brought to this
country by their parents. The 2012 modifications to the Interim Federal Health Program
potentially jeopardize the health, the safety and indeed the very lives, of these innocent and
vulnerable children in a manner that shocks the conscience and outrages our standards of
decency. They violate section 12 of the Charter..."
So.
Essentially, Mr. Alexander, Mr. Harper and their compatriots will be arguing that they should be allowed to subject innocent and vulnerable children to cruel and unusual treatment in the name of, in Mr. Alexander's own words, 'protecting the taxpayer'.
Can this really be any rational Canadian's view of Canada and all that it stands for?

Alexander will argue what the feds have done is not cruel and unusual. they are no worse off than if they had stayed in their own country. He might also argue they are not worse off than thousands of children who live on First Nations Reserves in the north. He may argue they have no right to be in Canada and therefor Canadian law does not apply to them. The list goes on. The Cons will argue anything just so long as health care is not provided to these people. If they could the Cons would ensure no health care were provided to Canadians either. This is as good a place to start as any.
The Cons don't care about any children in this country except their own. The money they allegedly would save is so small, especially for the health care of children, all the cons would have to do is give up their limos for a yr or hey, Harper can stay in Canada for a change and not spend a million when he goes to Israel.
